Contested Divorce Lawyer

What is a contested divorce?

A contested divorce is one where the spouses do not agree on whether to divorce, or on terms such as custody and maintenance. The petitioner must establish a legal ground before the court.

Common grounds

For Hindu marriages, Section 13 of the Hindu Marriage Act, 1955 lists grounds such as cruelty, desertion, adultery, conversion, unsoundness of mind and others. Other personal laws and the Special Marriage Act have their own grounds.

What to expect

  • Filing a petition and serving notice on the other spouse.
  • Written statements, evidence and cross-examination.
  • Possible mediation or interim orders on maintenance or custody.
  • Final arguments and judgment, with appeal options.
